GENERAL TERMS AND CONDITIONS1. General Provisions
1.1. These General Terms and Conditions (hereinafter referred to as the “Terms”) govern the rights and obligations between the provider of digital content and the consumer arising in connection with the conclusion of a distance contract for the provision of digital content through a website.

1.3. The customer is a natural person – consumer who concludes a contract with the Provider through the website (hereinafter referred to as the “Customer”).
2. Subject of the Contract
2.1. The subject of the contract is the provision of digital content – a guided audio recording Source Point (hereinafter referred to as the “Digital Content”).
2.2. The Digital Content is provided exclusively in electronic form and not on a physical medium.
3. Order and Conclusion of the Contract
3.1. The Customer orders the Digital Content through the website:

3.2. By submitting the order, the Customer confirms that they have familiarized themselves with these Terms and agree to their content.
3.3. The contract between the Provider and the Customer is concluded at the moment the order is confirmed and the payment is credited to the Provider’s account.
4. Price and Payment Terms
4.1. The price of the Digital Content is stated on the Provider’s website at the time of ordering.
4.2. Payment is made in advance via a payment gateway or bank transfer.
4.3. After payment is completed, the Customer receives access to the Digital Content.
5. Delivery of Digital Content
5.1. The Digital Content is delivered electronically, primarily through a link sent to the Customer’s e-mail address.
5.2. The Customer is responsible for ensuring they have the technical equipment necessary to access and play the Digital Content.
6. Withdrawal from the Contract
6.1. The Customer acknowledges that the Digital Content is provided otherwise than on a physical medium.
6.2. The Customer expressly agrees to the commencement of the provision of the Digital Content before the expiration of the withdrawal period.
6.3. The Customer acknowledges that by granting this consent, they lose the right to withdraw from the contract pursuant to Section 19(1)(m) of Act No. 108/2024 Coll. on Consumer Protection.
7. Liability and Limitation of Liability
7.1. The Digital Content is intended for personal development and self-exploration purposes.
7.2. The Provider does not guarantee any specific results, effects, or subjective experiences of the Customer.
7.3. The Digital Content does not replace professional medical, psychological, or therapeutic care.
8. Copyright, Intellectual Property and Contractual Penalty
8.1. The Source Point Digital Content, including the audio recording, texts, title, concept, structure, accompanying materials, and all parts thereof, is protected as copyrighted work under Act No. 185/2015 Coll. Copyright Act, as amended.
8.2. Copyrights to the Digital Content belong exclusively to the Provider or persons authorized by the Provider to exercise such rights.
8.3. By purchasing the Source Point Digital Content, the Customer acquires a non-exclusive, non-transferable, and unlimited right to use the Digital Content solely for personal use.
8.4. Without prior written consent of the Provider, the Customer is not authorized to:
copy the Digital Content,
distribute it,
provide access to third parties or the public,
use it within courses, therapies, groups, or commercial activities,
sell, rent, or otherwise commercially exploit it,
modify, translate, or create derivative works.
8.5. The Customer acknowledges that by purchasing the Digital Content, they do not acquire ownership rights to the work, but only the right for personal use under these Terms.
8.6. In the event that the Customer breaches the obligations stated in this article, especially by unauthorized sharing, distribution, or enabling third parties to use the Digital Content, the Customer agrees to pay the Provider a contractual penalty of €1,000 (one thousand euros) for each individual breach.
8.7. Payment of the contractual penalty does not affect the Provider’s right to compensation for damages, including damages exceeding the amount of the contractual penalty.
8.8. The Provider is entitled to claim the contractual penalty regardless of whether actual damage has occurred.
8.9. The contractual penalty is payable within 14 days from the delivery of the Provider’s written notice to the Customer.
9. Personal Data Protection
9.1. The Provider processes the Customer’s personal data in accordance with GDPR and Act No. 18/2018 Coll.
9.2. The purpose of processing personal data is the performance of the contract and provision of the Digital Content.
9.3. Detailed information regarding personal data processing is provided in a separate Privacy Policy document.
10. Final Provisions
10.1. These Terms are valid and effective from the date of their publication on the Provider’s website.
10.2. Legal relationships not governed by these Terms are subject to the laws of the Slovak Republic, especially Act No. 108/2024 Coll. and the Civil Code.
10.3. By proceeding to payment and paying for the recording, the Customer confirms that they have read and agree to these Terms.

COMPLAINT POLICY

2. Subject of Sale
The subject of sale consists of digital products — especially audio and audiovisual recordings, guided meditations, educational recordings, and other electronic content provided online after payment has been completed.
The digital content is delivered electronically in the form of a download link or online access.
3. Liability for Defects
The Provider is responsible for ensuring that the digital content:
is technically functional,
can be downloaded or played,
corresponds to the description provided on the website.
The following are not considered defects:
subjective evaluation of the content,
individual expectations of the customer,
personal experience or interpretation of the content.
4. Submitting a Complaint
A complaint may be submitted electronically via the e-mail address listed on the Provider’s website.
The complaint must include:
customer’s full name,
e-mail used during the order,
date of purchase,
description of the technical issue.
5. Complaint Resolution Period
The Provider shall resolve the complaint without undue delay, no later than 30 days from the date of its delivery.
6. Method of Complaint Resolution
In the event of a justified complaint, the customer is entitled to:
re-sending of a functional access link,
correction of the technical issue,
an appropriate discount,
a refund if the defect cannot be resolved.
7. Withdrawal from the Contract – Digital Content
In accordance with applicable consumer protection legislation regarding distance selling, the customer does not have the right to withdraw from the contract after the digital content has been made available if:
the provision of digital content began with the customer’s explicit consent,
the customer was informed that by granting such consent, they lose the right to withdraw from the contract.
By purchasing the digital product, the customer confirms that they have been properly informed of this fact.
8. Final Provisions
This Complaint Policy becomes effective on the date of its publication on the Provider’s website.

PRIVACY POLICY1. Introductory Provisions
1.1. This Privacy Policy (hereinafter referred to as the “Policy”) describes the method of processing personal data of natural persons in connection with the provision of the Source Point digital content through the website.
